Terms and Conditions

Last updated: Sep 03, 2025
1. About these Terms These Terms and Conditions govern your use of ourcartly.com and any purchase from Cartly (“we,” “us,” “our”), operating from 20 Regan Rd Unit 4, Brampton, ON L7A 1C3, Canada. Cartly sells a growing range of products across categories including outdoor wellness products (such as outdoor saunas), consumer electronics, home goods, and daily consumer products. By placing an order or using this site, you agree to these Terms.
2. Eligibility You must have reached the age of majority in your province or territory of residence (18 in AB, MB, ON, PE, QC, SK; 19 in BC, NB, NL, NS, NT, NU, YT) to purchase from us.
3. Product descriptions We make reasonable efforts to ensure product descriptions, images, dimensions, and specifications are accurate. For handcrafted or natural-material items (such as wood-built outdoor saunas), minor variation in grain, tone, or finish between units is normal and not a defect. For electronics and home goods, specifications are supplied by the manufacturer and may be updated without notice. Images are representative and may differ slightly from the item received.
4. Pricing and payment
  • All prices are listed in Canadian dollars (CAD) and exclude applicable GST/HST/PST, calculated at checkout based on your delivery province or territory.
  • Large or made-to-order items (such as custom-sized outdoor saunas) may require a deposit at checkout, with balance due before dispatch; this will be clearly disclosed on the product page before you order.
  • Standard-stock items across all categories are charged in full at checkout.
  • We reserve the right to correct pricing errors and to cancel an order at any stage, in which case any payment made will be fully refunded.
5. Electrical and certified products Any electrical product we sell — including sauna heaters and future electronics — intended for use in Canada is sold as CSA-certified or otherwise certified for the Canadian market where required by law. Products requiring professional installation (such as 240V sauna heaters) must be installed by a licensed electrician in accordance with the Canadian Electrical Code and local permit requirements. Installation is the customer’s responsibility unless an installation service is explicitly purchased.
6. Assembly and setup Some items (e.g., outdoor saunas, furniture, certain home goods) require on-site assembly. Unless you’ve purchased an assembly/installation add-on, assembly is the customer’s responsibility; instructions and support are provided with every applicable order.
7. Daily consumable products For daily consumable products (e.g., food, beverage, personal care, or household consumable items), we comply with applicable Canadian labelling, safety, and expiry-date requirements under the Food and Drugs Act, Consumer Packaging and Labelling Act, and related regulations. These items are intended for personal use only and are not resalable once opened.
8. Force majeure We are not liable for delays caused by events beyond our reasonable control, including material or component shortages, severe weather, carrier disruptions, or customs delays.
9. Your statutory rights are not affected Nothing in these Terms limits any right or remedy you have under mandatory consumer protection legislation in your province, including implied warranties of merchantable quality and fitness for purpose. Where any clause conflicts with such rights, your statutory rights prevail.
10. Limitation of liability To the maximum extent permitted by law, Cartly is not liable for indirect, incidental, or consequential damages arising from use of our products, except where prohibited by applicable Canadian consumer protection law.
11. Governing law These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Quebec residents: nothing in these Terms requires you to submit to mandatory arbitration or waive your right to participate in a class action, as such clauses are unenforceable against consumers under Quebec’s Consumer Protection Act.

12. Changes to these Terms As our product range grows, we may update these Terms to reflect new categories or services. Continued use of the site constitutes acceptance of the current version.
